What To Do When The Police Deny Registering Your FIR?

Ever heard or encountered an event where Police have denied registering the FIR or after so many appeals they have failed to register the formal Complaint?
There have been so many instances where such events have taken place or we have heard about it as its common people are often refused FIR registration. These things have always made us think that getting FIR lodged is of no good and police never take any such actions. And for this, we don’t even blame you.
To help you regarding this issue we have decided to come up with an article which will educate you with the remedies available for a citizen that he/she can exercise as an aggrieved person.

There are two remedies that a person can use when they have been denied the registration of their FIR. These two remedies are as follows:
Approach Higher Police Personnel :
If the concerned police officer refuses to register your FIR u/s 154(3) CRPC even after the offense is cognizable and falls under the jurisdiction of the concerned police officer then he/she can approach the higher police personnel i.e. station house officer (SHO) of that police station or can reach out to Deputy Commissioner of police of that jurisdiction or other higher-ranked police officer.
2. Approach Judicial Magistrate :
If even after reaching out to the higher-ranked police personnel doesn’t help you out in getting your FIR registered you can reach out to the Judicial Magistrate of your area’s jurisdiction for your help. Every citizen who is deprived of its legal right to get the FIR registered is legally entitled to approach the judicial magistrate and file its complaint u/s 200 CRPC read with section 156(3) CRPC requesting the magistrate to register your complaint and start its investigation.
Also note that if you have suffered any damages because of the inaction of police, you can file a Writ Petition in High Court & Supreme Court for it.
